Implementation and dissemination

"4. PRINCIPLES OF IMPLEMENTATION
The signatory parties acknowledge that the principles of implementation below aim to continually promote and sustain the shared ambitions of social and environmental progress.
Therefore, the parties jointly propose to establish areas of competence to further develop their constructive and innovative discussions in line with the roll-out of the 2017 Agreement and the Addendum."

Subject to mutual agreement, the signatories may extend the scope of the list of areas of competence in accordance with regulatory developments relating to Duty of Care."

"4.4. Implementation
The signatories shall distribute this Addendum and the 2017 Agreement to all their respective organisations. Geopost undertakes to distribute this Agreement and the Addendum to its Business Units and “Partners” in the languages used in the countries concerned."

"4.5. Undertakings
In addition, Geopost confirms its undertaking to implement actions, in particular training sessions designed to facilitate and create the conditions necessary to deploy this Addendum for the Managers of its Business Units in the country concerned. These training sessions will cover the 2017 Agreement, its Addendum and local labour relations. UNI Global Union's Post & Logistics Department will contribute constructively to any training or support material at Geopost's request as agreed by both parties. Training content will be updated regularly.
The UNI Global Union Post & Logistics Department shall, where possible, invite Geopost HQ and/or BU managers to its forums and/or other events to continually develop its relations and exchanges on labour relations and social dialogue in the broadest sense.

UNI Global Union and its affiliates shall endeavour to resolve any disputes peacefully by following the conflict resolution procedure (see 4.3) so as not to disrupt customer service or damage Geopost's reputation. UNI Global Union shall refrain from any public communication until Geopost has been informed of the issue in sufficient detail to be able to apply the conflict resolution procedure and undertakes to encourage its affiliates to exhaust good faith communication and local conflict resolution procedures before engaging in industrial action, media campaigns or corporate campaigns.

Geopost and UNI Global Union undertake to distribute the Addendum internally to their respective affiliates and BU Managers and Partners. Both parties undertake to disclose externally and publish the 2017 Agreement and its Addendum as well as the relationships and activities arising therefrom."

 

Review and monitoring

"4.2. ORGANISATION
A Steering Committee, composed of the signatories and the delegation of trade union representatives appointed by UNI Global Union, meets at least twice a year within the framework of the 2017 Agreement. The Steering Committee is responsible for the proper implementation of the 2017 Agreement and its Addendum, as well as the ability to raise structural issues, in the interest of Geopost’s “Employees” and “Partners”.
Geopost shall provide the Steering Committee with all the necessary resources to perform its duties properly.
Additional experts may be invited to attend and participate in Steering Committee meetings if the Steering Committee members agree unanimously. The Steering Committee will propose work themes, especially in relation to 4.1. The Steering Committee will produce an annual report on its activities, which will include social and environmental indicators.
The Steering Committee may decide, by mutual agreement between Geopost and UNI Global Union, in the event of urgent and very important problems, to set up technical working groups in order to examine in greater depth the working themes arising from the aforementioned areas of competence relating to compliance with the duty of care requirements.
The resources allocated and committed for the proper operation and implementation of this Addendum are specified in Appendix 2. This Addendum and the establishment of the aforementioned working groups effectively supersede Articles 2 and 8 of the 2017 Global Agreement."

 

Dispute settlement and sanctions

"4.3. Dispute and conflict management process

4.3.1.
Local issues shall be dealt with locally as a matter of priority. Any disputes shall first be dealt with locally between local management and local “Employees’” and “Partners’” representatives, in accordance with local legislation and procedures, and with existing collective labour agreements where applicable.
If either party to this Addendum is aware of an actual or potential conflict locally, the other party shall be informed as soon as possible in order to prevent new conflicts from arising. Both parties undertake to raise their organisations' awareness of social dialogue and the spirit of this Addendum with a view to resolving the said conflict.
If the issue is not resolved locally, it may be formally raised with the Steering Committee. The Steering Committee will examine any issue submitted to it, including any supporting documents, with the aim of resolving the issue as quickly as possible and preventing new issues from arising.
The Steering Committee will develop appropriate proposals to facilitate a potential local resolution. If one of the signatories declares that a matter is important and urgent, it may refer it immediately to the Steering Committee and an in-person or online meeting will be scheduled within 14 days.

4.3.2.
If the parties are unable to resolve a dispute concerning the application of the 2017 Agreement or this Addendum after the matter has been discussed in the Steering Committee, the matter may, by mutual agreement, be referred to a neutral mediator in order to find a solution through mediation and/or negotiation.
If the dispute in question has not been resolved by mediation or other means, either party may request a final and binding settlement by way of arbitration in accordance with the International Labour Arbitration and Conciliation Rules ("ILAC Rules" Appendix 4).
For the sake of clarity, the above dispute resolution procedure does not apply to disputes which – directly or indirectly – concern, affect or involve a collective labour agreement and/or any other local agreement. Such disputes will be resolved in accordance with the dispute resolution procedures set out in the relevant collective labour agreements and/or local agreements."
